How do you solve a problem like Maria

We've had the same neighbors for over a year now. Every time I've wanted to post something about them I had to restrain myself because I never had anything nice to say. Now we are posting because we need your help. There is a poll set up for you to help us. Let me explain the situation.

Jorge and Maria moved in a year ago. Jorge was awesome but we never liked Maria. She yells and screams at Jorge all of the time. She's called the cops on him multiple times (but she's the crazy abusive one). She smokes incessantly. The smoking is the real problem. It's against the contract of the duplex we live in (which she never read because she doesn't understand english very well) and we hate it because the smoke seeps up through the floor into our apartment. We've gone to church smelling like we just came from a bar because of the second hand smoke. We've used pregnancy as an excuse and talked to her about it, and we've complained to management about it half a dozen times. Last time we complained we were told that for every complaint we gave they were fined $100 and next time we complain they'll get evicted. So we felt bad and didn't complain for a while.

Now, Jorge has been evicted by Maria, and her smoking has increased.
Should we call and have Maria and her 8 year old newly baptised son kicked out onto the street, so we can be smoke free for another month?
Or should we just suck it up (literally) until we move?

  1. Are you kidding? I mean, I know, it's hard to be responsible for sending someone out to find another home but if it's seriously to the point that you are smelling like smoke?!!! Oh dear. If she were my neighbor... well, she wouldn't be. That sounds awful!! That's not healthy for you OR the baby and I'm not going to sit here and let Miss Maria make our little nephew sick!! I'm kind of in an outrage. Smoking makes me like this. I'll step off my soapbox for a minute... a MINUTE. But please, evict them. It's honestly in your best interest, in the apartments best interest (therefore the landlord's best interest), and it sounds like Miss Maria needs a little lesson learning anyways. Sheesh. I'm out of breath.

  2. Yikes. I'm sorry. I would also probably go ahead and complain again. It's against the rules, you are the ones suffering, and the next tenants would probably complain, anyway. Although.... as you said, what about her newly baptized son? What a conundrum!

  3. Get her out of there!!! If she can pay rent there, she can pay rent somewhere else. You can not place the blame for them being evicted on yourselves. She has made the choice over and over again to ignore the restrictions of the contract and will only be suffering the consequences of that choice. Definitely tell the land lord and enjoy a little fresh air!

  4. after two days in a row with it being pretty smelly in our bedroom and bathroom, benjamin made the call to management. we haven't heard anything back from them, and we're not sure what to expect. thanks for your support and thoughts...we don't feel so wicked looking at the poll. we'll keep you posted...

  5. i vote eviction. sorry maria. i am way too untolerant, intolerant (in, un?) for smoking.
